Maricopa County Still a Festering Wound
Recalcitrant officials refuse to take essential steps for election security...
Las Vegas, NV September 21, 2024… It is indeed unacceptable for a foreign entity to have full control over any elections in America, yet the officials responsible for elections here in America have approved of it. Why does a third-party company, especially one with ties to Serbia, have the passwords that can control or alter election results? Merrick Garland, USAG openly says that American election systems will be hacked by Russia. “Russia is taking a whole of government approach to influence the election, including the presidential race,” an official from the Office of the Director of National Intelligence said this summer during a briefing. The official spoke on condition of anonymity under rules worked out with that office.1 “Whole of nation” is spook speak for every means available, including surrogates (think Serbia).

Who is responsible for the systemic failures that reach across time? The same vulnerabilities have existed since before 2016 when Congressional Democrats, including Kamala Harris, first raised hell over the cybersecurity issues that they claimed were exploited to put Donald J Trump in office.2 Never mind the fact the Election Assistance Commission (EAC) is supposed to certify machines as suitably secure.
Misfeasance, nonfeasance, and malfeasance…
Knowing of security exposures and failing to take action is more than simple incompetence. Misfeasance, nonfeasance, and malfeasance are types of failure to discharge public obligations existing by common law, custom, or statute. The terms misfeasance and nonfeasance are most often used concerning the conduct of municipal authorities regarding the discharge of their statutory obligations; and it is an established rule that an action lies in favor of persons injured by misfeasance, by negligence in the discharge of the duty but that in the case of nonfeasance the remedy is not by action but by indictment or mandamus3 or by the particular procedure prescribed by the statutes.
For example, in the case of failure to repair public highways, the courts are astute to find evidence of carelessness in the discharge of public duties and on that basis to award damages to individuals who have suffered particular injury.
So what about an injury to the polity, the body politic?
Now comes yet another litigation…
In order to accomplish what should have been done in 2022 when Kari Lake and I brought suit in the U.S. District Court, Arizona, against the Secretary of State and counties that use “black box” ballot tabulation systems, the Maricopa County Republican Committee has served the county’s election executives with notice of intent to file suit. The term “black box” is a legal term of art that describes a system that one cannot see inside of; it lacks transparency vis s vis, a secret system.
President John F. Kennedy spoke to the repugnance of secrets4 and secret societies. At minute 6:41, “[W]e are as a people inherently and historically opposed to secret societies, to secret oaths, and to secret societies…”
